EXPItalia.com is a digital platform dedicated to the promotion, search, presentation and booking of experiences, activities and tourism services offered by travel agencies, tour operators, DMCs, guides, NCC operators, transport companies, experience providers and other professional operators in the tourism sector.
The EXPItalia commercial project and the EXPItalia.com domain are managed by MONDO ESCLUSIVO S.r.l. - Infovacanze, Via Porta Est no. 20, 30020 Marcon (VE) - Italy, VAT no. 04073530273, hereinafter also referred to as “EXPItalia” or the “Platform Manager”.
For the provision and operation of its digital services, EXPItalia may make use of third-party technology providers, IT infrastructure, management systems, hosting services and payment service providers, without prejudice to the ownership and commercial management of the Platform remaining with Mondo Esclusivo S.r.l.
Unless expressly indicated otherwise, EXPItalia is not the entity that organizes, produces or materially provides the tourism services published on the Platform. The contract relating to the tourism service purchased through EXPItalia is entered into directly between the Customer and the Operator that offers and sells the service.
For the purposes of these Terms and Conditions, the following definitions shall apply:
EXPItalia provides Operators with a digital space through which they can present, promote and market their Services and allows Customers to search for tourism services, request information, contact Operators and, where applicable, proceed with a booking.
The Platform operates through two different methods:
In this second case, EXPItalia’s sole function is to put the Customer in contact with the Operator. From the moment the request is forwarded to the Operator, all subsequent commercial, informational, pre-contractual and contractual relations are handled directly and independently between the Customer and the Operator.
EXPItalia does not take part in the subsequent negotiation, preparation of the quotation, definition of the economic terms, conclusion of the contract, collection of payment, any modification or cancellation of the service, or management of any refunds relating to bookings concluded directly between the Customer and the Operator following a contact generated by the Platform.
Any conclusion of the contract outside EXPItalia’s direct booking system takes place under the responsibility of the Operator and the Customer, according to the conditions agreed between them.
EXPItalia is not a party to any contract concluded between the Customer and the Operator following a Lead or Request generated through the Platform and assumes no responsibility for conditions, statements, promises, quotations, changes, agreements, payments or other arrangements subsequently entered into directly between the Customer and the Operator outside the Platform, without prejudice to the obligations and liabilities mandatorily imposed on EXPItalia by law.
EXPItalia facilitates the meeting of supply and demand for tourism services and provides the digital infrastructure necessary for presenting offers, generating requests and, where provided, technically managing bookings. The presence of a Service on the Platform does not mean that EXPItalia is its organizer or provider.
The identity of the Operator responsible for the Service must be made available to the Customer on the Service page and/or during the request or booking process.
When the Customer uses the booking system available on the Platform, the contract relating to the Service is concluded directly between the Customer and the Operator upon the latter’s final confirmation.
When, on the other hand, EXPItalia generates a request for contact, information, availability, a quotation or a booking which is subsequently handled directly by the Operator, any contractual relationship is concluded independently between the Customer and the Operator outside the Platform.
In both cases, the Operator is the party responsible for offering, organizing and providing the Service. EXPItalia provides the digital infrastructure and facilitates contact between Customer and Operator, but remains unrelated to the material provision of the Service and, in the case of leads, also to the subsequent negotiation and conclusion of the contract between the parties.
EXPItalia does not assume the status of carrier, guide, escort, rental company, accommodation facility or organizer of the activity, unless this is expressly indicated in the specific offer.
Information relating to the Services, including descriptions, photographs, availability, itineraries, duration, prices, participation conditions, accessibility, included and excluded services and cancellation policies, is provided by the Operator.
The Operator is responsible for the accuracy, completeness and updating of information relating to its Services. EXPItalia may carry out checks on published content and may request that the Operator make changes, additions or clarifications.
EXPItalia may also suspend or remove content that is manifestly incorrect, unlawful, misleading or non-compliant with the Platform rules.
Each Service may be subject to specific conditions established by the Operator. Before making a Booking, the Customer must carefully verify such conditions, with particular reference to dates and times, departure or meeting point, duration, minimum or maximum number of participants, age and participation requirements, required documents, included and excluded services, cancellation policy, weather conditions and any limitations relating to children, animals, luggage or persons with reduced mobility.
The specific conditions indicated on the Service page form an integral part of the contract concluded between the Customer and the Operator.
To submit a request or make a Booking, the Customer must provide complete, correct and up-to-date information.
A Customer who submits a request or makes a Booking on behalf of other persons declares that they are authorized to provide the relevant data and undertakes to communicate to the other participants all information and conditions relating to the Service.
Depending on the selected Service, EXPItalia may allow: a) the use of a booking system integrated into the Platform; b) the submission of a request to the Operator, which will subsequently be handled directly by the Operator.
The submission of a request, its receipt by the Platform or any automatic communication sent by EXPItalia does not, in itself, constitute final confirmation of the Booking. Final confirmation is the responsibility of the Operator.
In the case of leads or requests subsequently handled outside the Platform, the conditions, prices, payment methods and every other element of any resulting contract will be defined directly between the Customer and the Operator.
The applicable price is the price displayed during the Booking process. Unless otherwise indicated, the price includes the taxes and mandatory charges applicable to the Service.
Any additional costs not included in the price must be indicated on the Service page or otherwise communicated before the Booking is concluded.
EXPItalia does not charge the Customer any booking fees in addition to the displayed price, unless this is expressly indicated before purchase.
When payment is made through the booking system integrated into EXPItalia, the amount payable for the Service is collected directly by the Operator selling the Service.
EXPItalia does not collect the price of the Service on its own behalf and does not assume the status of seller of the Service purchased.
Electronic transactions may be processed through Stripe or other payment service providers integrated into the Platform. Payment is credited directly to the Operator’s payment account according to the technical procedures provided by the system used.
EXPItalia does not acquire control of the amounts paid by the Customer to the Operator and does not retain commissions on the value of the individual transaction, except for any different conditions expressly communicated.
Where the contact was generated by EXPItalia but the booking is subsequently concluded directly between the Customer and the Operator, the payment methods are also defined and managed exclusively between those parties. EXPItalia remains unrelated to the collection of payment and the related financial transaction.
Final confirmation of the Booking is always the responsibility of the Operator responsible for the Service.
Following the submission of a request or use of the booking system, EXPItalia may send the Customer an automatic communication or technical confirmation certifying the correct receipt or transmission of the request. Such communication from EXPItalia does not replace the Operator’s final confirmation.
The Booking shall therefore be considered finally confirmed only when the Customer has received the relevant confirmation from the Operator.
Any payment made or authorized does not, in itself, constitute final confirmation of the Booking.
If payment has been made but the Operator does not confirm the Booking, the Operator shall directly and promptly process the reversal or full refund of the amounts collected, according to the procedures provided by the payment system used.
As EXPItalia has neither collected nor obtained control of the amounts paid by the Customer, it does not assume the obligation to make such refund directly.
The Operator’s final confirmation must contain or refer to the information necessary to use the Service. The Customer must promptly verify its accuracy and report any errors or discrepancies directly to the Operator.
The possibility of modifying or cancelling a Booking depends on the specific conditions established by the Operator for the Service purchased. Before purchase, the Customer must therefore verify the cancellation conditions indicated in the relevant offer.
Where the applicable conditions provide for a right to a full or partial refund, the refund will be made directly by the Operator, as the party that received payment for the Service.
EXPItalia does not collect or hold the amounts paid by the Customer and is therefore not the party obliged to execute the refund. EXPItalia may, where applicable, provide technical or communication tools to facilitate the handling of the request, without thereby assuming the refund obligation.
In the case of bookings originating from a lead generated by the Platform and subsequently concluded directly between the Customer and the Operator, any request for a change, cancellation, return or refund must be handled exclusively with the Operator.
The Operator may, in the cases provided for by the Service conditions, modify or cancel the activity for organizational or safety reasons, due to weather conditions, failure to reach the minimum number of participants, force majeure or other circumstances preventing the Service from being provided.
In the event of cancellation by the Operator, any refund due to the Customer will be made directly by the Operator that collected the amount payable.
Where permitted and with the Customer’s consent, the Operator may alternatively offer a new date, a replacement Service or another equivalent solution.
In the event that the Customer or participants fail to appear at the indicated place and time, the conditions established by the Operator shall apply. Unless otherwise provided, a no-show attributable to the Customer may result in the loss of the right to a refund.
The Customer is responsible for checking in advance the time, meeting point, travel times and all other information necessary to participate in the Service.
Any refund due in relation to a purchased Service is made directly by the Operator that received the relevant payment.
EXPItalia does not hold the amounts paid by the Customer and does not assume the obligation to return amounts collected by Operators.
In the case of payments made through the tools integrated into the Platform, EXPItalia may make available the technical functionalities necessary to manage the refund, which nevertheless remains under the responsibility of the Operator.
In the case of bookings or contracts concluded directly between the Customer and the Operator following a lead or request generated through EXPItalia, the refund will be handled exclusively between the Customer and the Operator.
The consumer’s right of withdrawal applies in the cases and within the limits provided by applicable law.
For services concerning leisure activities, transport, catering, vehicle rental, non-residential accommodation and other categories for which the law provides for specific exceptions, the right of withdrawal may be excluded when the contract provides for a specific date or period of performance.
Any cancellation right granted by the Operator remains distinct from the statutory right of withdrawal and is governed by the specific conditions indicated for each Service.
The Operator is responsible for the Service published and sold through EXPItalia and declares and guarantees, under its own responsibility, that it is legally authorized to conduct its business; that it holds the required licenses, authorizations, qualifications, registrations and insurance coverage; that it complies with applicable tax, administrative, tourism, professional and safety regulations; that it provides correct and up-to-date information; that it applies to the Customer the conditions communicated; that it provides the Service in accordance with the published description; and that it complies with applicable consumer protection regulations.
The Operator must promptly notify EXPItalia of any suspension, revocation, lapse, non-renewed expiry or modification of licenses, authorizations, qualifications, registrations, insurance coverage or other requirements necessary for the lawful offering and provision of the Services published on the Platform.
In such circumstances, the Operator must immediately suspend the publication and sale of the Services for which the necessary requirements are no longer met.
EXPItalia is responsible for the proper functioning of the Platform within the limits reasonably attributable to its own activities.
EXPItalia is not responsible for the material provision of Services offered by Operators. To the extent permitted by law, EXPItalia is therefore not liable for service disruptions, delays, cancellations, accidents, breaches, conduct or omissions directly attributable to the Operator or to other parties involved in the provision of the Service.
EXPItalia remains responsible for obligations that the law directly imposes on the Platform Manager and for facts directly attributable to it. No provision of these Terms and Conditions may be interpreted as excluding or limiting liability where such exclusion is prohibited by law.
Neither EXPItalia nor the Operator may be held liable, within the limits provided by law, for the inability to perform their respective obligations arising from unforeseeable or unavoidable events beyond their reasonable control.
Such events may include, by way of example, natural disasters, exceptional weather conditions, fires, floods, earthquakes, epidemics, measures adopted by public authorities, strikes, wars, civil unrest, extraordinary transport disruptions or other similar circumstances.
Some Platform functionalities may require the creation of an account. The Customer is responsible for keeping their credentials confidential and for activities carried out through their account.
The information provided must be correct and up to date. EXPItalia may suspend or close accounts used fraudulently, unlawfully or in violation of these Terms and Conditions.
It is prohibited to use EXPItalia for unlawful or fraudulent purposes or in any way that may compromise the operation of the Platform. It is also prohibited, among other things, to attempt unauthorized access, interfere with computer systems, use unauthorized automated tools to systematically extract data or content, publish unlawful content or use the Platform to harm other users or operators.
EXPItalia may allow Customers to publish reviews, ratings, photographs or other content relating to the Services used.
EXPItalia requires that reviews and content published by users be truthful, relevant and refer to experiences or Services actually known or used by the author.
EXPItalia reserves the right not to publish or to remove reviews and content that are manifestly false, unlawful, offensive, fraudulent, irrelevant or contrary to the Platform rules.
Users may report to EXPItalia content, offers or activities that they consider unlawful or contrary to these Terms and Conditions through the contact details made available by the Platform.
EXPItalia may examine the report and take the measures it deems appropriate in accordance with applicable law, including the suspension or removal of the relevant content or Service.
The EXPItalia trademark, trade name, EXPItalia.com domain, content owned by the Platform and other distinctive elements belonging to Mondo Esclusivo S.r.l. are protected by applicable law.
The software components and other technological solutions used by the Platform may belong to third-party technology providers or their respective rights holders.
Content relating to individual Services supplied by Operators remains the property of the respective rights holders. Publication on the Platform entails the granting to EXPItalia of the rights of use necessary for the display, promotion and marketing of the Service for the period during which it is published.
The processing of users’ personal data is carried out in compliance with Regulation (EU) 2016/679 - GDPR and applicable national legislation.
The processing methods, purposes, legal bases, retention periods and data subjects’ rights are described in the relevant Privacy Policy available on the Platform.
As part of the execution of a Booking or the management of a Lead/Request, certain data of the Customer and participants may be communicated to the Operator to the extent necessary to manage the request and/or provide the Service.
Communications relating to a request or Booking may be made through the Platform, by email, SMS or other communication tools indicated during the procedure.
The Customer is responsible for the accuracy of the contact details provided and must check the communications received before the scheduled date of the Service.
Any complaints concerning the provision of the Service must be addressed to the responsible Operator.
EXPItalia may assist the Customer in communicating with the Operator and in handling the report, without thereby assuming the Operator’s contractual liability.
The Customer is encouraged to report any problems also to EXPItalia so that the Platform can carry out the appropriate checks on the Operator and the published Service.
EXPItalia may suspend or remove an Operator or a Service from the Platform in the event of contractual violations, credible reports, misleading information, failure to meet the required professional requirements, risks to Customers, unlawful activities or other circumstances incompatible with the proper operation of the Platform.
The suspension, removal or termination of the Operator’s account does not release the Operator from its obligations relating to Bookings already received or confirmed. The Operator remains fully responsible for their management, the provision of the Services, communications to Customers and, where the Service cannot be provided, the cancellations and any refunds due.
Where the suspension results from the loss of the requirements necessary for the provision of the Service or from circumstances that may compromise the safety or rights of Customers, the Operator must refrain from providing the Service and promptly fulfil the resulting obligations towards Customers.
The rights of Customers relating to Bookings already made remain unaffected.
EXPItalia undertakes to keep the Platform reasonably available and operational. However, temporary interruptions may occur due to maintenance, updates, technical problems, security interventions or causes beyond the Manager’s control.
To the extent permitted by law, EXPItalia does not guarantee that the Platform will be continuously available and error-free.
EXPItalia may amend these Terms and Conditions for regulatory, technical, organizational or commercial reasons. Amendments will be published on the Platform with an indication of the update date.
For Bookings already completed, the terms and conditions in force at the time the Booking was concluded will continue to apply, except for amendments imposed by law.
These Terms and Conditions are governed by Italian law. Where the Customer is a consumer, the mandatory rights granted under applicable national and European consumer protection legislation remain unaffected.
For disputes with Customers who qualify as consumers, jurisdiction shall lie with the court identified in accordance with the applicable mandatory rules and, in particular, with the court of the consumer’s place of residence or domicile in the cases provided by law.
For relationships with persons acting in the exercise of their business, commercial or professional activities, unless otherwise required by mandatory law, the Court of Venice shall have exclusive jurisdiction.
In the cases provided for by applicable law, the consumer may have recourse to the competent alternative dispute resolution (ADR) bodies.
The former European ODR platform for online dispute resolution has been discontinued and is therefore no longer available for the submission of new complaints.
If any provision of these Terms and Conditions is declared null, invalid or ineffective, this shall not automatically result in the invalidity of the remaining provisions, which shall continue to apply to the extent permitted by law.
For information concerning the operation of EXPItalia, reports or assistance with the Platform, users may use the contact details published in the “Contacts” section of EXPItalia.com.
For matters concerning the performance, modification, cancellation or refund of a specific Service, the Customer may contact the Operator indicated in the Booking confirmation directly, without prejudice to the possibility of requesting assistance from EXPItalia.
