CANCELLATION AND WITHDRAWAL POLICY
General terms and conditions applicable to package holidays and travel services
1. Regulatory References
This cancellation policy has been drawn up in compliance with the Italian Tourism Code (Legislative Decree No. 79/2011, as amended by Legislative Decree No. 62/2018 implementing EU Directive 2015/2302 on package travel and linked travel arrangements) and the applicable provisions of the Italian Consumer Code (Legislative Decree No. 206/2005). These conditions apply to package travel contracts and linked travel services offered by the Organiser.
2. Traveller's Right of Withdrawal
The traveller has the right to withdraw from the contract at any time before the start of the package, in accordance with Art. 41 of the Tourism Code. Should the withdrawal not be attributable to exceptional and unavoidable circumstances, the cancellation fees set out in Article 3 below shall apply.
Withdrawal without cancellation fees:
The traveller may withdraw from the contract without incurring any cancellation fees in the following cases:
Exceptional and unavoidable circumstances occur at or in the immediate vicinity of the destination that significantly affect the performance of the package or the carriage of passengers to the destination;
The Organiser unilaterally makes a significant alteration to one of the main characteristics of the package (e.g. price, destination, dates, downgraded accommodation);
The Organiser is unable to meet the specific requirements of the traveller that were previously agreed upon and confirmed in writing.
3. Standard Cancellation Fees
Should the traveller withdraw from the contract for reasons not falling within the exempt cases referred to in Article 2, the following cancellation fees shall apply, calculated on the total price of the package:
More than 60 days before departure:
Full refund of the amount paid, excluding any non-refundable booking management fees expressly stated at the time of reservation.
From 59 to 30 days before departure:
Cancellation fee equal to 25% of the total package price.
From 29 to 15 days before departure:
Cancellation fee equal to 50% of the total package price.
From 14 to 7 days before departure:
Cancellation fee equal to 75% of the total package price.
From 6 days up to and including the day of departure / no-show:
Cancellation fee equal to 100% of the total package price.
Note: for certain types of service (charter flights, cruises, special events, holiday periods) more restrictive cancellation conditions may apply, as specifically indicated in the individual contract.
4. Transfer of the Contract
The traveller may transfer the package travel contract to a third party who satisfies all the conditions applicable to the contract. The transfer must be communicated to the Organiser on a durable medium within a reasonable period of time, and in any case no less than 7 days before the start of the package, unless a shorter deadline is specified in the contract. The transferor and the transferee shall be jointly and severally liable for the payment of the outstanding balance and any transfer fees.
5. Cancellation by the Organiser
The Organiser reserves the right to cancel the package holiday in the following cases:
Failure to reach the minimum number of participants indicated in the contract, with notice given to the traveller within the legally prescribed deadlines (20 days before departure for trips lasting more than 6 days; 7 days before for trips between 2 and 6 days; 48 hours before for day trips);
Occurrence of exceptional and unavoidable circumstances that make it impossible to perform the package.
In such cases, the traveller shall be entitled to a full refund of all payments made within 14 days of the cancellation, with no right to any additional compensation from the Organiser.
6. Refund Procedures and Timelines
Refunds due to the traveller shall be paid within 14 days from the date of receipt of the withdrawal or cancellation notice, using the same method of payment used at the time of booking, unless otherwise agreed in writing between the parties. The Organiser shall not be held responsible for any delays attributable to banking institutions or third-party payment processors.
7. Travel Cancellation Insurance
Travellers are strongly advised to take out an insurance policy covering the risk of travel cancellation. The Organiser may, upon request, offer supplementary insurance products to cover such eventualities. Taking out an insurance policy does not alter these cancellation conditions, but enables the traveller to recover any fees retained through the insurance company, within the limits and conditions of the policy itself.
8. Notice of Cancellation
Any notice of withdrawal or cancellation must be submitted to the Organiser in writing (by e-mail, registered letter with acknowledgement of receipt, or certified electronic mail) and shall be deemed effective from the date of actual receipt by the Organiser. For the purpose of calculating cancellation fees, the date of receipt of the written notice shall prevail.
9. Governing Law and Jurisdiction
This contract is governed by Italian law. In the event of any dispute arising from the interpretation or performance of the contract, the parties undertake to first attempt mediation in accordance with Legislative Decree No. 28/2010. Should mediation prove unsuccessful, the competent court shall be that of the consumer's place of residence or domicile, pursuant to Art. 66-bis of the Italian Consumer Code.
This document constitutes the Organiser's general cancellation policy. Specific conditions may be set out in the individual package travel contract, which shall prevail over these general provisions in the event of conflict. Document updated in accordance with Legislative Decree No. 62/2018.
